Disable Hotkeys when a Modal dialog is open

Hi,

I have implemented Hot key on Case submission "Submit" button. Before submitting a case, there is also a modal dialog that also has a submit button. Hot key is working as expected for manual created cases. 

I'm seeing an issue when I'm  trying to submit  automatically created cases (cases created from agent), modal pop and as well as the parent case in the back ground is getting submitted. 

 

Can I get some help here please.
